Let us tell you that in India, people of 60 years or above are considered senior citizens. On the other hand, people aged 80 years or more are considered very senior citizens. Maintenance and Welfare of Parents and Senior Citizens Act 2007 has been made for senior citizens in India. Apart from this, the government has also made a National Policy for Older Persons which protects the rights of the elderly in India. All the needs of senior citizens are met in both these policies. These include financial security, medical security, maintenance expenses and all security.

Legal right to snatch property

In India, a very important law has been implemented to legally secure the care of the elderly, which is called “Maintenance and Welfare of Parents and Senior Citizens Act, 2007.” The purpose of this law is that no elderly person should feel lonely and helpless at the last stage of his life. If an elderly person is not in a position to take care of himself, whether he is financially weak or physically helpless, then it becomes the responsibility of his family members to take care of him. If the heirs refuse all these responsibilities, then the court can take away the property rights from them.

The court can give the decision under this law

If an elderly citizen, who has given his hard-earned property to his children or heirs on the trust that they will take care of him, but later the same children or heirs start ignoring him or misbehaving with him, let alone serving him, then in such a case the elderly are no longer helpless. They have a legal way to get back the property given to them.

According to the Maintenance and Welfare of Parents and Senior Citizens Act 2007, if an elderly person feels that the property given to him by deceiving him or on the condition of service is now causing insult or neglect, then he can change this situation. For this, he has to file a petition not in any big court, but in the Senior Citizen Tribunal i.e. a special tribunal. After this, the court can order to return the property.
